TERMS AND CONDITIONS

This agreement is made between the partner organization, herein referred to as the Partner Organization, acting on behalf of the parent/guardian and the beneficiary of therapy services, herein referred to as the Family/Client, and the Rehabilitation and Empowerment of Adults and Children with Handicap Foundation, Inc., herein referred to as REACH.

The Partner Organization on behalf of the Family/Client is seeking Physical Therapy, Occupational Therapy, Speech and Language Therapy, Education Tutorials, and/or related services from REACH as duly referred by a physician.

In consideration of the above, the parties hereby agree to the following terms and conditions:

SCOPE OF SERVICES FOR THE FAMILY/CLIENT

REACH agrees to provide the needed services to the Family/Client whenever possible by its volunteers, staff, interns, and partners in coordination with the Partner Organization.

TERMS OF AGREEMENT

The terms of this agreement will begin upon the REACH’s confirmation of the  Partner Organization’s request for therapy, educational, and/or related services for Family/Client’s and shall end once the Partner Organization has expressed in writing its intent to discontinue.   

INVESTMENT AND PAYMENT TERMS

Fees, payment terms and inclusions will be based on the service package as agreed upon by the Partner Organization. See attached Service Package details.

CANCELLATION POLICY

The Family/Client agrees to provide the Partner Organization with at least twenty-four (24) hours notice of any cancellation of a scheduled session. It is the responsibility of the Partner Organization to ensure the proper coordination of the Family/Client to attend their scheduled session. If the Family/Client and/or the Partner Organization fails to provide REACH with at least a 24 hour cancellation notice,  without valid reason, the session will still be accounted for as one validly rendered teletherapy  session.

CONFIDENTIALITY

REACH and the  Partner Organization shall maintain the confidentiality of all information related to the Family/Client’s therapy, including but not limited to the Family/Client’s personal information, medical history, treatment plan, and progress. The volunteer service providers shall likewise not disclose any such information to any third party without the Family/Client’s written consent, except as required by law.

The Partner Organization has communicated verbally and in writing to the caregivers and families that their children's data and information related to therapy will be shared with the partner organization to coordinate their access to teletherapy services. Contact information of Family/Client is to be shared with potential volunteer therapists for coordination of teletherapy sessions.

Out of respect for the therapists' private space, the Family/Client is not permitted to call the therapists' personal phone numbers without their permission. They can call the REACH Foundation, Inc. or the Partner Organization  if they have questions or concerns.

TERMINATION

Either party may terminate this agreement at any time upon giving the other party due notice.

JURISDICTION

This Agreement is governed by Philippine law, and the parties submit themselves to the jurisdiction of the courts of Mandaluyong City, Philippines.

In the event of a dispute arising out of or by reason of this Agreement, the parties shall exert diligent efforts at reaching an amicable agreement. In case no amicable resolution is reached, any action or proceeding arising out of or in connection with this Agreement shall be exclusively brought before the appropriate courts.

The Volunteer and Family/Client agree that in the instance of legal proceedings they will cooperate with the REACH and the Partner Organization.
